05 policies on labor – salary, social insurance, effective January 2023

From January 2023, a series of new policies on labor – salary, social insurance, allowances for cadres, civil servants, public employees and employees came into effect.

1. Process of settling social insurance once authenticated by digital signature

The process of settlement of one-time social insurance benefits with pilot application of digital signature authentication integrated in mobile applications according to Decision  422/QD-TTg  issued together with  Decision 3612/QD-BHXH  in 2022 .

Subjects of pilot application are those who enjoy one-time social insurance and have been issued social insurance books according to regulations.

To carry out this process, employees fully and accurately declare information according to Form No. 14A-HSB provided on the Public Service Portal, digitally sign Form No. 14A-HSB, and upload documents. electronically or citing documents from an individual’s electronic data management repository and submitting documents on the Public Service Portal.

Employees are not required to declare and return data, records and papers already in the database managed by the social insurance agency or which have been digitized, stored, connected and shared by the competent authority. information with the Public Service Portal, an electronic one-stop information system.

2. Guide to salary ranking of Bank civil servants

Circular 14/2022/TT-NHNN  stipulating codes, professional and professional standards and salary classification for the ranks of specialized banking civil servants takes effect from January 1, 2023.

Accordingly, the appointment and grading of salaries into the ranks of specialized banking civil servants must be based on the job position, responsibilities, duties and professional profession undertaken by the civil servant.

When changing rank from the rank of civil servant currently held to the rank of specialized civil servant in the banking industry, it is not allowed to combine the salary increase or increase the rank of civil servant.

Regarding the salary arrangement, the Circular clearly states that the ranks of specialized civil servants in the banking sector shall apply Table 2 (Professional and professional salary table for cadres and civil servants in state agencies) issued together with the Decree  . 204/2004/ND-CP  as follows:

– The rank of Senior Controller of the Bank applies the salary scale of civil servants grade A3, group 1 (A3.1), from salary coefficient 6.20 to salary coefficient 8.00;

– The rank of Chief Controller of the bank applies the salary scale of civil servants grade A2, group 1 (A2.1), from salary coefficient 4.40 to salary coefficient 6.78;

– The Bank Controllers rank applies the A1 salary scale for civil servants, from the salary coefficient 2.34 to the salary coefficient 4.98;

– The storekeeper and bank cashiers apply the A0 salary scale for civil servants, from the salary coefficient 2.10 to the salary coefficient 4.89;

– Cash Employee – Treasury class applies the salary scale of class B civil servants, from salary coefficient 1.86 to salary coefficient 4.06.

The change of salary ranking for civil servants from the ranks of specialized civil servants currently held to the ranks of specialized banking employees specified in  Circular 14/2022/TT-NHNN  shall comply with the guidance in Clause 2, Section II  of this Circular. 02/2007/TT-BNV  dated May 25, 2007 of the Ministry of Home Affairs guiding salary grading when raising ranks, changing ranks, changing types of civil servants and public employees.

3. Guidelines for collection of union fees and expenses in 2023

The content of guidance on collection of trade union fees and expenses is mentioned in  Instruction 65/HD-TLD  and  Decision 5440/QD-TLD  dated October 10, 2022.

The amount of trade union dues collected in 2023 is determined on the actual number of union members (with comparison with the General Confederation’s Organizing Committee) at grassroots trade unions multiplied by the members’ wages and allowances.

4. Increase occupational incentive allowances for preventive and grassroots health workers

Next is the adjustment to increase occupational incentive allowances for preventive medicine and grassroots health workers.

This content is mentioned in  Resolution 69/2022/QH15  of the National Assembly on the state budget estimate in 2023.

Accordingly, from January 1, 2023, to increase the occupational incentive allowance for preventive medicine and grassroots health workers according to Conclusion 25-KL/TW dated December 30, 2021 of the Ministry of Health. Politics.

5. Social insurance benefits for redundant employees when reorganizing state companies

Decree 97/2022/ND-CP  stipulating policies for redundant employees when changing ownership or rearranging a one-member limited liability company in which 100% of charter capital is held by the State. force from January 15, 2023.

In particular, the policy for redundant employees who were last recruited before April 21, 1998 or before April 26, 2002 is as follows:

– Redundant workers whose age is from full 01-05 years younger than the retirement age and have paid compulsory social insurance premiums for full 20 years or more are entitled to pension and the following regimes:

+ Not being deducted from the rate of pension enjoyment due to early retirement;

+ Allowance for 03 months’ salary/year (full 12 months, excluding odd months) to retire before the age in comparison with the retirement age;

+ Support for an amount equal to 0.4 of the average monthly minimum salary for each working year with social insurance premiums.

– Redundant workers whose age is less than 1 year old compared to the retirement age and have paid compulsory social insurance premiums for full 20 years or more are entitled to pension and benefits including:

+ Not being deducted from the rate of pension enjoyment due to early retirement;

+ An amount equal to 0.2 of the average monthly minimum salary for each working year with social insurance premiums.

– Surplus employees who reach the retirement age but still lack the time to pay compulsory social insurance premiums for up to 06 months to be eligible for pension shall be paid once by the State for the missing months to the retirement fund and die. Surviving to settle retirement…
