New policy on labor – salary effective July 2022

The new policy on labor – wages will take effect from July 2022.

 

1. Adjustment of regulations on periodical report on labor change

On May 25, 2020, the Government issued Decree  35/2022/ND-CP  stipulating the management of industrial parks and economic zones, including amending and supplementing a number of contents related to the report. Periodically report on labor changes in Decree  145/2020/ND-CP .

Accordingly, the report on labor change is still carried out by the enterprise every 6 months and annually, sent to the Department of Labor, War Invalids and Social Affairs and notified to the social insurance agency. the district where the head office, branch or representative office is located.

But Decree 35 also adds regulations for reporting on labor changes in industrial parks and economic zones.

Specifically, Clause 1, Article 73 of Decree No. 35/2022/ND-CP stipulates that, for an employer working in an industrial park or economic zone, the employer must report the change of employees. to the following three agencies:

– Department of Labor, War Invalids and Social Affairs.

– The district social insurance agency where the head office, branch or representative office is located.

– Management boards of industrial zones and economic zones for monitoring.

This Decree takes effect from July 15, 2022.

2. Officially increase the regional minimum wage from July 1, 2022

After two years of not increasing the regional minimum wage due to the impact of the Covid-19 pandemic, the Government has finally decided to increase the regional minimum wage for workers across the country.

Specifically, in Decree  38/2022/ND-CP , effective from July 1, 2022, the new regional minimum wage is regulated as follows:

22,500 VND/hour

4,160,000 VND/month

20,000 VND/hour

3,640,000 VND/month

17,500 VND/hour

Thanks to the increase in the regional minimum wage, the salary for stopping work, the minimum wage when transferring jobs, and the maximum unemployment allowance of employees also increase.

In addition to stipulating an increase in the monthly regional minimum wage, Decree 38 also specifically stipulates the hourly regional minimum wage. This is the basis to protect the benefits of wages for employees who are doing part-time jobs.

3. Policy to support poor district workers to export labor

In order to well implement the National Target Program on Sustainable Poverty Reduction in the 2021-2025 period, the Ministry of Labour, War Invalids and Social Affairs has issued Circular 09/2022/TT-BLDTBXH guiding a number of contents for multi-faceted  implementation  . diversify livelihoods, develop poverty reduction models and support workers to work abroad under contracts.

Accordingly, workers in poor districts and communes with special difficulties in the lowlands, coastal areas and islands wishing to work abroad will be supported as follows:

– Ethnic minority people, Kinh people belonging to poor households living in ethnic minority areas and mountainous areas; People from near-poor households, households just getting out of poverty in poor districts, communes with special difficulties in the lowlands, coastal areas and islands wishing to work abroad:

+ Vocational training and vocational skills training.

+ Support for foreign language training: Maximum 04 million VND/person/course.

+ Support for meals and living expenses during the training period: 50,000 VND/person/day.

+ Support for accommodation during the training period: 400,000 VND/person/month.

+ Support for uniforms, blankets, mosquito nets, shoes…: 600,000 VND/person.

Fees for passports, judicial records, visas, health checks, etc.

– Kinh people belonging to near-poor households living in ethnic minority and mountainous areas are supported:

+ Money for vocational training, supplementing vocational skills.

+ Support for foreign language training according to actual costs, up to 70% and support other expenses according to the level of support for ethnic minorities, Kinh people belonging to poor households.
